A Jamaican man who raped a sleeping woman cannot be deported from the UK after release from prison because he is bisexual, judges have ruled. The Home Office said on Monday that they made “no apology” for having attempted to deport the offender after he served a seven-year sentence for what an immigration tribunal accepted was a “serious offence”. But an upper tribunal judge rejected arguments by Home Office lawyers that the man, who cannot be identified, remained “a danger to the community” and upheld a decision allowing him to remain in the UK. The ruling by Melissa Canavan noted that the man, known only as AA, had been convicted in 2018 of forcing himself on a sleeping woman who was under the influence of alcohol while he had been smoking cannabis and drinking at a party.
At the time the man had claimed that he did not know that having sex with someone who was sleeping was rape.
