只因为有订婚，就可以强制发生性行为？订婚等于性承诺，彩礼等于卖身钱，而且还是卖身为性奴？婚内都可以成立强奸了，还要否定订婚后的强制性行为构成强奸罪，这是生活在大清朝吗？退一步说，就是在大清朝，怕是也不允许以已订婚为由强制对女方实施性侵行为吧。
另外，什么时候强奸罪的既遂标准变成射精或处女膜破裂了？无论是理论通说还是实务立场，一直采取的是插入标准吧。如果有其他的证据证明有插入，就可以构成强奸既遂，没有相应的证据当然另说。
性的自主权是专属于个人的，并不因订婚或结婚而丧失，强制的性行为侵害了相对方的性的自主权，连这也要质疑要推翻？更何况，订婚在法律上根本没什么意义，双方之间并未就此进入婚姻，仍然只是男女朋友关系。以订婚的地方风俗意义为由，否认强制的性行为构成强奸，难道大同是法外之地？
本来不想评论这个案件的，因为事关他人的隐私，并且原以为订婚不等于性同意是现代社会的常识，根本无需多言。哪里能想到，会有这么多人还生活在大清朝，后脑拖着丑陋的辫子而不知自丑。

I just remember he said they plan open source it. I agree with you, sooner you do it, better, at least from security stand point. But I guess there are trade offs. Dunno. Observing the project for now...
