The Lula government (PT) published a joint decree on Tuesday (20) that provides for a one-time payment of R$ 60,000 for children up to 10 years old who were born with a disability caused by the Zika virus during pregnancy. The financial support application should be made to the INSS (National Social Security Institute), mainly through the Meu INSS app. The child with a disability must have been born between January 1, 2015 and December 31, 2024, and the relationship between the syndrome and the mother's contamination will be evaluated by Social Security. According to the decree, signed by the ministries of Social Security and Health and the INSS, the financial support should be provided until the end of December, and applications should be made by October 31. The benefit was created from a government provisional measure that expires on June 2. On the last day, June 16, Minister Flávio Dino of the Supreme Federal Court (STF) decided that even if the provisional measure expires, the right to compensation should be met. Dino decided that, although the measure had not been voted on by the National Congress, the benefit should be granted in the name of the legal security of the beneficiary families, "in observance of the principle of the predominance of the best interest of children and adolescents and the constitutional stature of the rights of people with disabilities." The request was made to the STF by the family of a child in this condition, which sought a provisional and urgent measure to require the INSS to provide appropriate communication channels for the benefit application. The Zika virus was first identified in Brazil on April 28, 2015, and in the following months, it led to the birth of thousands of babies with microcephaly.
