Antifa militants in Portland, including Elizabeth Renee Richter, are trying to organize direct actions against the local ICE facility https://nitter.poast.org/ICEgov. Richter, who I sued previously for rallying her comrades to try to kill me in downtown, shared a video allegedly showing ICE officers detaining someone in Portland.
On June 4, there was a far-left direct action at the ICE facility in response to news that a transgender illegal migrant would be deported. Antifa and the leftists had nothing to say about the illegal Muslim migrant accused of a terrorist attack in Boulder, Colo. just days earlier. Activist groups spread disinformation that three "comrades" were "abducted" by DHS. These individuals were cited for disorderly conduct and quickly released after trying to stop a van they believed to be transporting illegal migrants.
Additonally, far-left extremists are circulating a petition to Portland city council to demand that they revoke the permit for the building that ICE uses as a detention center. They also attempted this in 2018 when they occupied and attacked the building for weeks, with the then-mayor's blessing. There are more direct actions planned in the coming days.

만약 안전 인증 기업이 소비자의 피해를 유발한 가습기 살균제 기업에 인증을 부주의하게 제공했다면, 제조 기업뿐 아니라 인증 기업도 일정 책임을 지게 됩니다(참고로 현재는 이 인증 기업은 독점입니다ㅎㅎ 누가 독점하고 있을까요? 독점 상황에서 인증 기관에게 책임이 제대로 돌아갈까요?). 부주의한 인증을 한 책임이 있으니까요. 이 책임은 보험 계약을 통해 사전에 분산되어 있으며, 소비자는 자기가 가입한 보험을 통해 손해를 보상받게 될 겁니다. 소비자가 살균제 기업의 가습기 살균제로 피해를 입었으면 소비자는 자신의 소비자 피해 보험사에 피해를 신고합니다. 기업은 생산물 책임 보험을 통해 방어하거나 배상합니다.
가습기 살균제 사건이 발생했다면 일단 입증 책임은 피해자에게 있습니다. 피해자가 제대로 입증한다면 기업은 소비자에게 합당한 배상을 해야 합니다. 이는 기업이 가입한 보험 규약과 피해자가 가입한 보험 규약에 따라 이뤄질 거고 만약 두 규약 사이에 간극이 있다면 중재 기업이 필요합니다. 중재 기업은 피해자나 기업이 보험에 가입할 당시의 규약에 따라 선정될 겁니다. 뭐 분쟁 발생 시 어떠한 중재 기업을 사용한다는 규약이 있을 수 있겠죠.
만약 책임 소재가 명확한데 보험 기관이나 중재 기업이 소송을 질질 끄는 경우, 혹은 배상하는 것으로 판명났는데도 거부하면 어떻게 될지 상상해봅시다. 중재 지연이나 보험사의 배상 거부가 소비자들 사이에 알려지면, 소비자들은 해당 기업뿐 아니라 그 기업이 가입한 보험사 및 인증사를 거부하기 시작할 겁니다. 특히, 소비자 권익을 대변하는 고발 기관이나 보험사 평판 서비스 등이 이 정보를 집계하고 배포하는 걸로도 시장의 징벌적 기능을 강화할 수 있습니다. 이행을 거부하면 경제적 죽음을 당할 수도 있는데, 만약 한 공동체가 보험 규약에 의한 이행을 거부하거나 아무 보험에 가입하지 않은 무법자를 배제하기로 한 경우 그 무법자 기관 혹은 개인은 그 공동체에서 간단한 교환조차도 못할 수도 있습니다. 하여튼 소비자 수요를 맞히지 못하는 기업은 장기적으로 도태됩니다. 신뢰를 잃은 보험사는 살아남을 수가 없습니다…
저는 자유시장에서 오히려 책임 소재가 더 분명해질 거라 봅니다. 정부의 강제력이 없어도, 배상 이행은 민간 보험 규약(입법), 자유로운 계약, 중재 메커니즘을 통해 이뤄질 수 있습니다. 시장 선택이 신뢰와 강제력을 만들고 이를 통해 질서, 특히 사법 질서를 형성합니다.
시장이 단기적으로는요, 소비자 권리를 보호하지 못하고, 부당한 기업으로부터 로비를 받아 중재 기관이 중립성을 잃을 수도 있어요. 그러니 자생적 질서가 항상 작동할 거라고는 저도 장담할 수 없습니다만, 확신할 수 있는 건 장기적으로는 그 자생적 질서가 반드시 생긴다는 겁니다. 강제 없이도 그러한 질서는 생깁니다. 예를 들어 시장이 단기적으로는 중고차 사기처럼 정보의 비대칭 같은 문제가 있을 수도 있습니다. 그러나 결국에는 그러한 문제를 해결하는 중고차 이력 조회 기업, 중고차 중재 기업 등등이 생겨납니다. 자유시장에서요! 이건 무슨 중고차 기업들한테 너네 사기 치면 벌금! 이런 걸로 해결할 수 있는 문제가 아닙니다. 자유 시장은 이런 문제를 효율적으로 해결해요. 소비자가 원하면 거기서 이익을 취하고 싶은 기업가들이 등장할 수밖에 없습니다. 누군가 기업 진입을 강제로 막는 게 아니라면요.
그리고 무엇보다요… 개인에게 무장의 자유가 있으면 소비자에 대한 과도한 권리 침해는 일어나기가 더 힘듭니다. 과도한 소비자 권리 침해로 인해 감당해야 할 비용이 목숨이 될 수도 있거든요. 자연권 침해에 대한 비용이 너무 커져서 질서를 찾아가려는 압력이 매우매우 강해집니다. 어떠한 경우에도 비침해성 공리는 위반되면 안 되지만, 누군가 먼저 어겼다면 자연 상태 시작입니다. 보편 원리에 의해 자신의 자연권도 부정하게 되므로… 어쨌든! 인간은 질서를 찾아가게 되어있습니다. 자발적 계약이 시장을 꽃피우지, 강제와 협박이 꽃 피우지 않습니다. 인간 문명화를 이룩한 건 정부의 강제력이 아니라 인간 개개인들 사이에서 만들어진 자발적 교환, 자발적 계약입니다. 오히려 강제는 문명을 파괴해왔습니다.
