**Sessão que tornou Filipe Martins réu é novo marco em abusos do STF**

A sessão da Primeira Turma do Supremo Tribunal Federal (STF) que transformou em réu Filipe Martins, ex-assessor de Jair Bolsonaro, é um novo marco nos abusos Corte. Várias medidas atropelaram garantias básicas previstas na Constituição e no Código de Processo Penal, de acordo com diversos juristas e entidades de advogados.
Os principais abusos foram:
Proibição de imagens de Filipe Martins durante o julgamento e deslocamento em Brasília;
Ameaça de prisão se terceiros registrassem ou divulgassem sua imagem;
Restrição ilegal à circulação de Martins em Brasília;
Proibição de exercer qualquer atividade política durante a viagem ao STF, sem fundamento jurídico;
Lacração de celulares de advogados e jornalistas na sessão do julgamento;
Uso de provas de outros investigados e exibição de imagens fora dos autos durante a sessão;
Negativa de acesso a dados de geolocalização que poderiam provar sua inocência.
As ilegalidades começaram com a proibição de que Filipe Martins aparecesse em qualquer imagem durante seu deslocamento ou na sessão – mesmo que a gravação fosse feita por terceiros. A medida do ministro Alexandre de Moraes previa a possibilidade de prisão caso a ordem fosse descumprida.
A Constituição diz que "a lei só poderá restringir a publicidade dos atos processuais quando a defesa da intimidade ou o interesse social o exigirem", o que não se aplicava ao caso. Além disso, o Código de Processo Penal não prevê nenhuma medida cautelar com esse caráter.
A decisão também contrariou o princípio da responsabilidade pessoal ao prever sanção por atos praticados por outras pessoas, sem vínculo com o acusado – ou seja, feriu a noção de que ninguém pode ser punido por conduta alheia. "Não há nada mais medieval no direito do que ameaçar prender alguém por atos de terceiros", comentou via X o advogado André Marsiglia, professor de Direito Constitucional.
A limitação imposta à liberdade de locomoção de Filipe Martins foi outra ilegalidade. Embora tenha autorizado Martins a comparecer ao STF em Brasília, Moraes determinou que ele só poderia circular entre o aeroporto, o hotel e o prédio do Supremo.
Pelo X, o advogado criminalista Jeffrey Chiquini, mestre em Direito, afirmou que isso contraria Código de Processo Penal, que "traz um rol taxativo das medidas restritivas de liberdade que o juiz pode aplicar como cautelares, não podendo o magistrado inovar ou criar medidas que não estejam previstas no art. 319".
Outro abuso foi a vedação explícita à atuação política de Martins durante sua estadia em Brasília. A proibição, determinada textualmente por Moraes, também não está prevista no rol de cautelares admitidas pela legislação penal e, segundo a jurista Katia Magalhães, representa mais uma invenção sem amparo normativo.
"A imposição de cautelares, no crime, só se destina a garantir a ordem pública, e/ou a robustez das provas. A atividade política não acarreta riscos à segurança da sociedade e/ou das evidências. Seu exercício decorre da liberdade de expressão. Ao impedir a atuação política de Martins, Alexandre de Moraes escancarou que a 'gravidade' do caso reside na representatividade do rapaz como figura política. Colou, em Martins, o 'selo' de criminoso político, o que, em democracias, significa NÃO ser criminoso!", explicou ela via X.
**Lacração de celulares é medida sem precedentes e fere liberdade de imprensa**
O julgamento também foi marcado por uma medida sem precedentes: a lacração dos celulares de todos os presentes, inclusive advogados e jornalistas. Todos os presentes na sessão foram obrigados a entregar seus celulares, que foram colocados em envelopes. O objetivo seria evitar o registro de imagens, já que havia a proibição de que Filipe Martins fosse filmado ou fotografado.
A OAB (Ordem dos Advogados do Brasil), o MDA (Movimento de Defesa da Advocacia) e a AASP (Associação dos Advogados de São Paulo) emitiram notas se manifestando contra a medida, alegando que ela viola prerrogativas profissionais e restringe direitos garantidos por lei.
A OAB afirmou ter recebido "com surpresa e irresignação a decisão que determinou a lacração dos celulares de advogados e de profissionais da imprensa". "O uso de aparelhos para gravação de áudio e vídeo em sessões públicas é amparado por lei e constitui prerrogativa da advocacia, não podendo ser restringido sem fundamento legal claro e específico", disse a entidade.
Para o jurista Deltan Dallagnol, ex-deputado federal (Novo-PR), a decisão representa "censura à própria imprensa, porque impede a imprensa de fazer o seu trabalho".
A defesa de Filipe Martins também apontou falhas graves na construção da denúncia. Parte do material apresentado como prova se referia a documentos vinculados a outros investigados, como o ex-ministro Anderson Torres. A defesa sustentou que não havia relação direta entre Martins e o conteúdo citado pelo Ministério Público.
**Advogados criticam condução da sessão e apontam cerceamento de defesa**
Além das ilegalidades relacionadas às medidas cautelares contra Filipe Martins, houve uma série de abusos relacionados à condução do processo e do julgamento em si.
O advogado Sebastião Coelho apontou, por exemplo, que Moraes exibiu durante a sessão imagens que não constavam nos autos, como a de um ônibus incendiado em data e contexto diferentes dos fatos em julgamento. "Lamento muito que o eminente relator tenha colocado imagens que não estão no processo. Isso é irregular. Você não pode colocar para exposição pública uma imagem que não está no processo", afirmou em coletiva pós-julgamento.
Outro problema foi o acesso negado a dados de geolocalização que poderiam comprovar a ausência de Martins em reuniões citadas na denúncia. A defesa relatou que tentou obter os registros com a operadora de telefonia, na primeira instância e junto ao próprio relator, mas não teve sucesso. Segundo os advogados, os dados estavam em posse da Polícia Federal após a quebra de sigilo, mas não foram incluídos no processo.
A defesa argumentou que os registros solicitados comprovariam que Martins não estava presente nas datas indicadas pela acusação. Também afirmou que a informação era acessível com base na Lei Geral de Proteção de Dados, mas foi sistematicamente negada, o que configura cerceamento de defesa. Os advogados destacaram ainda que o local apontado como cenário das supostas reuniões com caráter golpista – o Palácio da Alvorada – era, na época, o local de trabalho do réu.

Day 1 trying to reduce my caffeine intake.
And I want to tell you about it.
I get angry way to quick. I cramp during workouts way to easy.
I normally have coffee twice a day. Once for breakfast.
Then again after lunch.
I skipped today's morning coffee. Had tea instead.
Head hurt. Felt sleepy. Now im drinking after lunch coffee.
Feels so good. Way better than normal.
I need a plan for tomorrow.
Im thinking tea twice tomorrow and no coffee.
