Uma ex-gestora da rede de farmácias São João que foi orientada pela então coordenadora a não contratar obesos, tatuados e homossexuais deverá ser indenizada por decisão do Tribunal do Trabalho da 4ª Região (TRT4).
A reparação por danos morais foi fixada em R$ 10 mil, a ser paga pela empresa. Não houve recurso da decisão, segundo o TRT4.

O caso aconteceu em 2021, quando um áudio atribuído à coordenadora foi compartilhado em redes sociais.
A 4ª Turma do TRT4 confirmou, por unanimidade, a sentença da juíza Marinês Denkievicz Tedesco Fraga, da Justiça do Trabalho de Tramandaí, no Litoral Norte do RS. A decisão foi proferida no dia 7 de abril e tornada pública na quarta-feira (14) pelo tribunal.
O g1 entrou em contato com a rede de farmácias São João, que afirmou que não vai se manifestar.
O caso aconteceu em 2021. Nas gravações, a coordenadora orientava os gestores a terem cuidado com a aparência e orientação sexual dos candidatos selecionados. Pessoas acima do peso, tatuadas, com piercings e homossexuais deveriam ser evitadas, e pessoas "bonitas" deveriam ser preferidas. (Ouça áudio acima)
Em juízo, a empresa afirmou que a orientação foi um caso isolado e que não representa os valores da instituição. A rede de farmácias alegou que após o fato foi instaurada uma sindicância que resultou no desligamento da coordenadora.
"É certo que as orientações repassadas ao grupo de gestores, do qual fazia parte a reclamante, configuram exigências discriminatórias, vedadas por lei", afirmou a magistrada Marinês, que julgou o caso em primeiro grau.
Igualdade e não discriminação, entendem desembargadores
Conforme o TRT4, no entendimento dos desembargadores Ana Luiza Heineck Kruse, João Paulo Lucena e André Reverbel Fernandes houve violação de direitos e a conduta infringiu princípios da igualdade e da não discriminação.
"Não se verifica, ainda, nenhuma resposta ou orientação específica para os gestores que foram destinatários e também vítimas da mensagem, porquanto o teor discriminatório atinge igualmente quaisquer dos gestores que tiverem identidade com os grupos discriminados pela coordenadora", pontuou a desembargadora.

No áudio, a mulher, que era coordenadora de rede no Litoral Norte, orienta as equipes quanto à contratação de trabalhadores para a rede. Ela pede que evitem "pessoas muito tatuadas" ou "muito gordas", além de pessoas de orientação sexual abertamente LGBTQIA+. Leia abaixo trechos do áudio.
A mulher havia sido admitida em 2008, e em 2020 foi promovida a coordenadora regional. Tinha sob sua supervisão lojas de oito municípios: Rolante, Santo Antônio da Patrulha, Osório, Imbé, Tramandaí, Cidreira, Balneário Pinhal e Palmares do Sul.
"Feio e bonito é o mesmo preço, né, gente. Então, vamos cuidar muito nas nossas contratações. Pessoas muito tatuadas, você sabem que a empresa não gosta. (...) Pessoas muito gordas, vocês sabem. Cuidem as aparências, cuidem as aparências".
"Se pegar alguém, com todo respeito, viado e tudo mais, tem que ser uma pessoa alinhada, que não vire a mão e desmunheque".
A mulher foi demitida da empresa. Em depoimento à polícia, ela alegou "arrependimento, sobrecarga de trabalho e problemas pessoais", e negou ter sido orientada pela empresa para discriminar candidato.
A ex-empregada também entregou o celular funcional, em que enviou a mensagem. Ela foi indiciada em 2022, e aceitou acordo de não persecução penal, mediante condições impostas pelo MP e homologadas pelo Poder Judiciário.
