The 2nd Special Court for Public Revenue of the Federal District condemned the Federal District to pay R$ 30,000 in moral damages to the daughter of a patient who died from a Cerebral Vascular Accident (CVA). The decision recognized failures in the care provided by the Mobile Emergency Care Service (SAMU), which removed the patient from the ambulance before transporting her to the hospital, contributing to her death five days later. The judge applied the theory of lost chance and explained that the negligent conduct of SAMU professionals made it impossible to provide immediate and adequate care, compromising the patient's real chances of recovery or survival. The decision can be appealed. According to the case files, after suffering seizures and vomiting, the patient was placed in the SAMU vehicle, but the care was interrupted because the team was called to respond to another emergency considered more severe. The patient was removed from the ambulance and left at home with only a nasal catheter and no oxygen. The Fire Department was later called and took her to the hospital, where she eventually died. The Federal District claimed it had no responsibility for the incident and argued that the patient's death did not result from the care provided. In analyzing the case, the court emphasized that the state must respond for damages caused by the actions of its agents, regardless of proof of fault. It was demonstrated that the SAMU professionals acted contrary to the medical protocol, which establishes immediate hospitalization in cases of convulsion. Although negligence was not the sole cause of death, the delay in care reduced the patient's chances of survival.
