Yeah, no one wants to hear this bc we have a religious devotion to the Constitution, but even if we can agree to keep the Bill of Rights and the three branches, the rest of it needs a whole rewrite.
It's impressive for what it was at the time, but there are lots of oversights, not nearly enough checks on judges probably being the obvious one.
The Constitution's reliance on Natural Law theory to justify itself also means liberals are right that the concept of an illegal foreigner doesn't make sense within the internal logical underpinnings of our legal system. The only way around that is to declare non-Whites inhuman, which would be based, but it won't happen, and this problem is going to keep coming back up until we have an actual legal basis for national exclusivity in the US.
It's dumb, no one on the Left or Right believes in Natural Law the way Enlightenment philosophers and the Founding Fathers did, it's a goofy idea that's been disproven both philosophically and scientifically.
