Yeah, I get the impression that the judgement actually strikes a pretty fair balance. The App Store terms have struck me as an overreach from the moment of its announcement. The newer devices up to this point seemed all about empowering creatives, now suddenly they introduced a blanket moral code for acceptable output, and claimed revenue percentages.
Still, as I remarked in another post this week, I think they effectively tried to streamline managing the legal obligations and liabilities on their side, and the Store seems more of a symptom of state laws, eg. warranty, moderation, identification.
