最近，我突然收到了一张法院传票，得知我竟然被360公司以侵犯名誉权为由起诉了，索赔金额高达10万元。
事情源于去年6月6日，周鸿祎在360AI浏览器发布会中，为了宣传360AI浏览器中的局部重绘技术，将一幅女性图片以“性感”为关键词对胸部区域进行局部重绘（“图生图”二创）。
但我注意到这张图与本人曾经在LibLib平台发布的AWPortrait1.2的示例图（由我本人创作的AIGC作品）高度相似，该示例图本人亦在多个平台进行发布过。因此，本人在网络平台针对360公司的行为发表合理质疑。
在此事得到各位朋友的关注后，对方公司副总裁梁志辉公开表态“愿通过法律途径解决版权争议”，然而在我积极准备维权材料之时，未料竟先被对方以“侵犯名誉权”为由起诉，我的合理质疑竟成了对方嘴里的“歪曲的、不实的、诋毁性言论”。
但我不知道我何时说过“360AI技术不行”这句话？还是说断章取义拼凑也算吗？
在这里需要强调的是，360公司副总裁梁志辉、公司员工、代理律师均在不同场合亲口承认过所涉争议图片系在我的「原创AI图片」上「重绘」而来。
在此，我想三问某公司：
第1， 我质疑的是发布会现场使用的AI图片没有尊重作者原创，未经授权的“重绘”二创行为侵犯了我的合法权益。名誉利益侵害应当是质疑内容对应实际名誉受损的主体，而本案发布会举办地及其搜索公司注册地均在北京，即便对方认为我侵权也应在北京进行诉讼，强行将管辖拉到天津究竟是出于什么考量？
第2， 我提出的诉求始终是要求360公司象征性赔偿1元并公开道歉，与此相对的是360公司对我提出了10万元的“天价赔偿”，这个赔偿是如何计算的，依据是什么？
第3， 此前多家媒体的公开报道中，360方均表示“愿依法解决版权争议”，但事实上对方在去年6月20日就拟好诉状准备起诉我名誉权侵权，所以“提起名誉权纠纷”并要求我赔偿10万“天价”就是360方所谓的版权纠纷的“依法解决方案”？
作为普通创作者，我不敢揣测互联网大厂选择管辖法院的考量，也不能理解10万“天价”（与我的1元相比）索赔金额的逻辑和依据，但我依然相信公开透明的讨论更有助于公众厘清事件全貌。
在此我也重申我的基本诉求：对于周鸿祎及360发布会未经授权使用我作品进行的“图生图”二创行为，我会坚持依法维权；对于名誉权侵权的不实指控，我也绝不会被迫认下我没有说过的话。
“重绘”算不算“抄袭”？“图生图”算不算侵犯原作者的合法权益？AI时代“二创”的边界到底在哪里？以上不是我一个人的疑问，被“二创”、被“图生图”、被“洗稿”亦是我背后千千万万创作者会面临的困境。AI时代，我们究竟该如何拿起法律的武器，维护我们自身的合法权益？
本次名誉权诉讼虽偏离著作权争议轨道，我仍会依法应诉维护我的合法权益，相信法院会给我一个公平、公正、公开的审判结果，让我作为当事人在司法案件中感受到公平正义。
我期待通过司法途径澄清事实，更期待回归真正的版权议题探讨。另案著作权及不正当竞争纠纷我和我的代理律师也在持续推进维权工作，我会拿起法律武器，等待属于我的公平正义！

大幕开启：美国五角大楼将正式引入AI进行作战规划和决策
请注意，这是一个真正的“战争游戏”（WOPR）
美国国防部与人工智能公司 Scale AI 签署了一项具有里程碑意义的合同，将正式引入AI（人工智能）参与军事行动规划和决策。这是迄今为止西方国家防务部门将AI纳入核心决策流程最显著的一次行动。
这项合同隶属于美国国防创新部门（DIU）名为“雷霆熔炉（Thunderforge）”的项目。尽管官方尚未透露具体金额，但鉴于该项目的广泛规模，可以推测合同金额不菲。
根据Scale AI发布的声明，公司将携手由虚拟现实创业明星 帕尔默·拉奇（Palmer Luckey）创办的安杜里尔公司（Anduril）和科技巨头微软组成的团队，共同落实这一计划。微软此前因大规模推广AI助手“Copilot”而广受关注，此次负责提供项目中的大语言模型（LLM），而安杜里尔公司则提供其成熟的军事AI平台“Lattice”。Scale AI则专注于AI智能体（agent）的开发与训练。

> “今天的军事规划方式仍在使用数十年前的技术和方法，与现代战争快速变化的节奏完全不匹配。‘雷霆熔炉’项目将以AI分析和自动化的能力，彻底革新军事的行动和战略规划，让决策者能以足够快的速度应对未来冲突。”
AI究竟会做些什么？
据介绍，“雷霆熔炉”计划的最终目标，是让军方决策人员能够更快速地处理大量情报，更迅速地作出基于AI分析建议的判断。AI将在任务规划、战役设计、战区资源分配以及战略评估方面提供支持。尽管最终决策权仍由人类掌握，但AI系统将发挥重要的辅助作用。
具体而言，这些AI智能体可用于桌面战争推演，模拟各种战争场景的后果，帮助决策者预测可能的结果并优化行动方案。
据透露，这套AI系统即将进入实地测试阶段，美国太平洋印太司令部（位于夏威夷）和欧洲司令部（位于德国）将率先部署该系统。五角大楼计划在测试成功后，逐步推广至其全部11个作战司令部。
DIU还明确表示：
> “雷霆熔炉标志着美军向AI驱动的数据化战争迈出决定性的一步，确保美军可以以前所未有的速度与精准度预测和应对威胁。”
Scale AI创始人兼CEO亚历山大·王（Alexandr Wang）则表示：
> “我们的AI解决方案将彻底改变当前美军的作战流程，推动美国防务现代化。”
安全争议与AI的可靠性问题
然而，将AI用于军事领域始终充满争议与风险。
此前，谷歌因参与以色列国防部项目，引发员工抗议甚至解雇员工；微软也因类似原因而解雇了抗议公司参与军事项目的员工。此外，以色列也已开始使用美国制造的AI模型进行战争行动。
谷歌和OpenAI近期甚至撤回了过去“不参与AI武器开发、不用于间谍活动及不违反国际准则”的承诺。
美国军方近年来已越来越多地使用AI技术进行情报分析、行动评估等非战斗用途。但此次将AI应用于核心军事决策，风险问题备受关注。
对于外界普遍担忧的AI安全性问题，DIU回应称，他们一直在积极制定军事AI的安全保障措施：
> “准确性和可靠性是设计的核心原则，人类监督仍是关键。这正是我们大力强调‘雷霆熔炉’AI决策过程透明化的原因，让决策人员能理解AI的逻辑推理，评估其建议的可信度，从而做出明智决策。”
此外，“雷霆熔炉”AI将与权威数据库连接，以确保使用最新、经过验证的信息，涵盖所有安全级别的数据。
DIU进一步表示，美国国防部目前使用的军事规划方法甚至可以追溯到拿破仑时代，面对未来无人系统和集群作战（Swarm Warfare）中决策以秒计算的速度，“雷霆熔炉”的出现势在必行，它将显著提高战略决策速度，同时保留人类决策的最终权威。
尾声趣事：新闻网站AI翻车事件
无独有偶，美国《洛杉矶时报》近日也启用了AI新闻助手，原本想用AI对文章进行自动总结和提出相反观点，却因AI在一篇回顾白人至上主义组织“三K党”在橙县遭驱逐的历史文章下，意外地为“三K党”进行了辩护。这一AI新闻助手在上线仅一天后就被迅速撤下。

Bitcoin is the ultimate pricing mechanism, when its price falls, it’s signaling that we need to create more value, not chase more liquidity.
Bitcoin’s incentives are clear: produce more, waste less, build smarter.
It’s not asking for permission; it’s forcing the transition.
Just as with the ETFs, it will take time for the market to absorb this reality, but when it does, the repricing will be violent.
Good news takes time to price in because those who understand it first are already maxed out, while the rest haven’t yet realized how badly they need Bitcoin.
The only question left: when the world wakes up, will you already be sovereign?
